Citation: 2022 VI 3Summary: In the prosecutions leading to the Superior Court’s January 9, 2020 judgment and commitment, which adjudicated this defendant guilty of numerous offenses stemming from his employment as Chief Executive Officer of the Roy L. Schneider Hospital, the People failed to introduce sufficient evidence to sustain his convictions under Counts 2, 3, 5, 6, 7, 8, 14, 16, 18, and 19; those convictions are reversed, and the Superior Court is directed to enter a judgment of acquittal on remand. Although the People introduced sufficient evidence from which a jury could properly render a conviction on Counts 3, 9, 10, 12, and 17, a new trial is ordered on those counts due to the failure of the Superior Court to take appropriate action to ensure that the jury rendered a unanimous verdict or to ascertain the value of the property stolen, embezzled, or falsely obtained as required by 5 V.I.C. § 3636. Accordingly, the January 9, 2020 judgment and commitment is reversed. The corresponding sentences and special verdict with order of forfeiture are vacated.
