Citation: 2024 VI 30Summary: Considering the Governor’s appeal from (1) a Superior Court judgment ruling that Act No. 8472, enacted by the Virgin Islands Legislature during the 2021 Regular Session, does not violate the separation of powers doctrine and is a valid exercise of legislative authority and (2) an accompanying order denying the Governor’s request for a permanent injunction and declaratory judgment and lifting the Superior Court’s preliminary injunction order enjoining the Virgin Islands Water and Power Authority from the enforcement and implementation of Act No. 8472, the Superior Court did not err in making its rulings concerning Act No. 8472, and further did not err in denying the Governor’s request for declaratory judgment. In addition, the Superior Court did not abuse its discretion, either by denying the Governor’s request for a permanent injunction, or by lifting the preliminary injunction order. Accordingly, the Superior Court’s memorandum opinion and order embodying its judgment is affirmed.Attachment: Open Document or Opinion
