Citation: 2024 VI 11Summary: Considering an appeal from the Superior Court’s June 25, 2019 and March 2, 2020 orders compelling arbitration and dismissing without prejudice a complaint filed by a former employee of the appellee, the Superior Court correctly determined that the causes of action asserted in the complaint were subject to the arbitration agreement. And while the Superior Court erred when it held that the Federal Arbitration Act, 9 U.S.C. § 1 et seq., governed the parties’ arbitration agreement, ultimately it correctly held that the former employee failed to meet his burden of establishing the unconscionability of that agreement. Accordingly, the Superior Court’s June 25, 2019 and March 2, 2020 orders are affirmed.Attachment: Open Document or Opinion
