Citation: 2021 VI 12Summary: Considering the Superior Court’s October 29, 2020 order denying a petition for habeas corpus, the Superior Court erred when it held that the petitioner did not establish a prima facie case that his incarceration was unlawful, and further erred when it failed to issue a ruling on his claim that his transfer violated the terms of the contract between the Government of the Virgin Islands and its contractor, a limited liability company that operates a detention facility in Florida. Both of these errors, however, are ultimately harmless. Moreover, the Superior Court committed no error when it held that the petitioner failed to provide sufficient information to allow it to consider his ineffective assistance of counsel claim, in that the petition did not identify the allegedly ineffective attorney by name and otherwise failed to provide sufficient detail as to such attorney’s alleged wrongdoing. Accordingly, the Superior Court’s October 29, 2020, order is affirmed.Attachment: Open Document or Opinion
